At the end of the afternoon of Tuesday June 28 and after a little more than two hours of deliberation, the Assize Court of Oise delivers its verdict, at the end of the debates which were held for two days. Two days during which, Vincent Ponthieux, 31, was not very talkative in explaining the reasons which led him, on the night of December 31, 2017 to January 1, 2018, to stab Benjamin Bokalo, 27, at the during a particularly wet New Year’s Eve in Beauvais.

In his submissions, Frédéric Simon, the Advocate General, is convinced that the accused is guilty of attempted voluntary homicide and is asking for an 8-year prison sentence with a warrant of committal. The tension is therefore palpable among the relatives of the respondent when the jurors and the judges of the assize court presided over by Martine Brancourt return to the courtroom.

A deferred deposit mandate

Finally, Vincent Ponthieux is acquitted for the attempted murder. But he was sentenced to 5 years in prison for willful violence with a weapon with a deferred committal order. The execution date will be set by the prosecution.

A judicial epilogue for a case that could have had dramatic consequences for Benjamin Bokalo. After suffering the attack, he was taken care of by the emergency room of Beauvais hospital in a state of absolute emergency, before being transferred to the university hospital center of Amiens. His vital prognosis remained engaged.

Very quickly the investigators had questioned one of the guests. He had explained that he was participating in this festive evening with Vincent Ponthieux and his companion, as well as one of his friends. When he received a phone call from Benjamin Bokalo. The latter told him that he had argued with his girlfriend and that she had left the house. He had then proposed to Benjamin Bokalo, in agreement with Vincent Ponthieux, to join them to spend the rest of this New Year’s Eve. According to him, everything was going normally until the moment when Vincent Ponthieux struck a blow with a bottle of champagne on the mouth of Benjamin Bokalo. Previously, Vincent Ponthieux’s companion had asked him to leave, because she could not stand his attitude towards women.

A bad reflex

Following this first attack, Benjamin Bokalo left the scene before being stabbed by Vincent Ponthieux, without anyone being able to give more details on the weapon used.

On January 1, 2018 shortly after 6 p.m., Vincent Ponthieu spontaneously went to the police station where he was placed in police custody. He then claimed that Benjamin Bokalo, who had become very aggressive, refused to leave. The respondent admitted to having had a bad reflex by hitting him with an empty bottle. He then added that he had taken the knife which was on the coffee table in the living room and had gone with his arm outstretched towards Benjamin Bokalo simply to scare him. He fiercely denied having intended to kill him.

Presented to the investigating judge, Vincent Ponthieux had been indicted for attempted murder. He had been left free, under judicial control. The judge of freedoms and detention had refused his provisional imprisonment.
