On July 9, 2022 on the D9001 which crosses Sainte-Geneviève, the gendarmes of Mouy checked a motorist who was driving too fast. On the day of the hearing on July 11, Jason Berger tries to put things into perspective: “I didn’t ride much, I was driving around the blockhe told the court, I have a sporty driving style“. But whether he has traveled ten meters or kilometers makes no difference: he no longer has the right to drive.

“I was clean, I let go”

Jason Berger also explains:I hadn’t used cannabis for three weeks, I was smoking CBD. I had just passed the test, I was clean. I let go. I borrowed a cigarette that I thought was CBD, but it was cannabis… I had to pass the code, this morning at 10 am… I have just suffered an economic redundancy and I found a job; as I no longer have the permit, it is a colleague who takes me there“.

The prosecutor notes:The facts are recognized but largely minimized. He is on repeat! She asks for the revocation of two months of her suspended sentence and adds eight months of prison arranged in house arrest under electronic bracelet, prohibition to pass the license before one year, the confiscation of her car and the prohibition to drive any motor vehicle for one year.

House arrest under supervision

The defense lawyer, Maxence Sarlin, asks the court to reduce the sentence requested by the representative of the prosecution as well as the placement of his client under house arrest for the entire sentence pronounced.

Jason Berger was found guilty. He was sentenced to six months in prison, including one for the revocation of his current suspended sentence. The court arranged the whole of this sentence in house arrest under electronic surveillance. He will have to wait until November 14 to apply for a new license and is prohibited from driving any motor vehicle for four months. His car is confiscated.
